FitToll - Terms of Use

Agreement to Terms

By downloading, installing, or using FitToll (“the App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.

Description of Service

FitToll is a digital wellness application that helps users manage their screen time by requiring completion of camera-verified physical exercises before accessing selected apps on their device. The App uses on-device pose estimation technology to verify exercises in real time.

Eligibility

You must be at least 13 years old to use FitToll. By using the App, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

Account Registration

To use certain features of FitToll, you may need to create an account using one of our supported authentication methods (Google, Apple, Facebook, or email/password).

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable Use

You agree to use FitToll only for its intended purpose as a personal digital wellness tool. You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Attempt to bypass, disable, or circumvent the exercise verification system
• Use the App to restrict access on devices you do not own or have authorization to manage
• Redistribute, sublicense, or resell the App
• Use automated tools, bots, or scripts to interact with the App
• Introduce malware, viruses, or other harmful code through your use of the App

App Blocking Feature

How It Works

FitToll uses platform-provided APIs (Apple FamilyControls/Screen Time API on iOS, UsageStats/Accessibility services on Android) to detect when blocked apps are launched and to display an exercise screen. You select which apps to block, and only you can modify this selection.

Important Disclaimers

• Voluntary Use: The app blocking feature is entirely voluntary. You choose which apps to block and can remove blocks at any time through the App.
• No Guarantee of Effectiveness: While we strive to provide reliable app blocking, we cannot guarantee that the blocking mechanism will work perfectly in all circumstances. Operating system updates, permission changes, or device-specific behaviors may affect functionality.
• Your Responsibility: You are solely responsible for deciding which apps to block. FitToll does not recommend or require blocking any specific apps.
• Emergency Access: App blocking should never prevent access to emergency services. FitToll does not block system-critical apps, phone, or emergency services.

Exercise Verification

Camera-Based Verification

FitToll uses your device camera and on-device machine learning to verify exercises. By using this feature, you understand and agree that:

• All camera processing happens entirely on your device — no images or video are transmitted or stored
• The exercise verification system uses pose estimation technology that may not be 100% accurate in all conditions
• Verification accuracy may be affected by lighting, camera angle, clothing, body type, and other environmental factors
• The App is not a substitute for professional fitness instruction or guidance

Physical Activity Disclaimer

Important: Consult your physician before starting any exercise program.

By using FitToll’s exercise features, you acknowledge and agree that:

• You are voluntarily participating in physical exercises
• You are solely responsible for determining whether you are physically fit and able to perform the exercises
• You should stop exercising immediately if you experience pain, dizziness, shortness of breath, or any discomfort
• FitToll is not a medical device, fitness trainer, or healthcare provider
• We are not responsible for any injuries, health issues, or physical harm that may result from performing exercises prompted by the App
• You assume all risks associated with physical exercise performed while using the App

Exercise Form and Safety

While FitToll attempts to verify exercise form through pose estimation, the verification system is designed to count repetitions and detect basic movement patterns. It is NOT a substitute for proper exercise instruction. We strongly recommend:

• Learning proper exercise form from a qualified fitness professional before relying on the App
• Starting with a low number of required repetitions and gradually increasing
• Exercising in a safe, clear space with adequate room to move
• Stopping immediately if you feel any pain or discomfort

Intellectual Property

Our Rights

FitToll, including its design, code, features, and content, is owned by Aurobindo Gupta and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

Your Content

You retain ownership of any data you create within the App (exercise preferences, blocked app selections, etc.). By using the App, you grant us a limited license to process this data solely for the purpose of providing the App’s functionality.

Third-Party Services

FitToll integrates with third-party services for authentication (Firebase, Google, Apple, Facebook). Your use of these services is subject to their respective terms of service. We are not responsible for the practices or policies of third-party services.

Availability and Updates

• We may update, modify, or discontinue the App or any of its features at any time without prior notice
• We do not guarantee that the App will be available at all times or free from interruptions
• Operating system updates may affect the App’s functionality, and we will make reasonable efforts to maintain compatibility
• You are responsible for keeping the App updated to the latest version for the best experience and security

Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF EXERCISE VERIFICATION
• UNINTERRUPTED OR ERROR-FREE OPERATION

WE DO NOT WARRANT THAT THE APP BLOCKING FEATURE WILL SUCCESSFULLY BLOCK ALL SELECTED APPS IN ALL CIRCUMSTANCES, OR THAT THE EXERCISE VERIFICATION SYSTEM WILL ACCURATELY DETECT AND COUNT ALL EXERCISES.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AUROBINDO GUPTA OR FITTOLL BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, DATA, OR GOODWILL
• ANY PERSONAL INJURY OR PHYSICAL HARM RESULTING FROM EXERCISE
• ANY DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP
• ANY DAMAGES EXCEEDING THE AMOUNT YOU PAID FOR THE APP (IF ANY)

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED.

Indemnification

You agree to indemnify and hold harmless Aurobindo Gupta and FitToll from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of a third party
• Any injury or harm resulting from exercises performed while using the App

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in India.

Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the “Last Updated” date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

For significant changes, we will notify you through the app or via email.

Termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including if you violate these Terms. Upon termination:

• Your license to use the App is immediately revoked
• You should uninstall the App from your device
• Provisions that by their nature should survive termination will survive (including Disclaimers, Limitation of Liability, and Indemnification)

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aurobindo Gupta regarding your use of FitToll and supersede any prior agreements.
